Referral Program – Terms and Conditions

 1. Overview

  • The OnSinch Referral Program (“Referral Program”) is designed by OnSinch, s.r.o., to appreciate and reward our loyal customers (“Referrer”) who share the contact details of the Referred Company with OnSinch via the form, email or phone. Both Referrer and Referred Company must be eligible as specified below.
  • By participating in this Referral Program, the Referrer acknowledges and agrees to the following terms and conditions (“Referral Program Terms”).
  • Current version of the Referral Program Terms may be accessed at any time on this page. OnSinch reserves the right to update, change or replace any part of these Referral Program Terms by posting updates and/or changes to the website.
  • The Referral Program is only available in locations where OnSinch services are available.

2. Period of validity

  • OnSinch reserves the right to terminate the Referral Program at any time. 
  • Termination of the Referral Program is without prejudice to right of the Referrer to claim a reward for a referral submitted prior to the termination.

3. Eligibility criteria

  • This Referral Program is open to eligible Referrer who refers eligible Referred Company.
  • Eligible Referrer is an active OnSinch customer.
  • Eligible Referred Company is a company which must commit to a minimum of 12-month subscription plan, with payments at least in the amount of €200 per month excluding VAT.

4. Reward conditions

  • Referrer should in the first step identify a company that could benefit from OnSinch's staff management solutions.
  • Referrer should in the second step share the contact details of the identified company with OnSinch via the form, email or phone. OnSinch will take the rest of the process from this point.
  • Referrals should be made in good faith to companies that the Referrer believes would benefit from OnSinch’s services. Referrer should avoid spamming or any other form of unsolicited communication towards other companies. If the Referred Company is located in Germany, the Referrer shall provide OnSinch with Referred’s company consent with communication regarding OnSinch’s services.
  • A referral is considered successful when the Referred Company within 12 months from the referral submission signs a minimum 12-month contract with OnSinch, with a subscription of at least €200/month excluding VAT, and completes their first payment. After that the Referrer will receive a discount of up to €2,700 on Referrer’s next OnSinch license payment(s). 
  • Rewards are cumulative. There is no limit to how many companies the Referrer can refer.

5. Exclusions from Reward Eligibility

  • Under the Referral Program, rewards cannot be granted for referring companies that are directly or indirectly affiliated with the Referrer. In particular, no reward will be granted for referrals of:
    • a parent or subsidiary company,
    • companies that are part of the same corporate group as Referrer,
    • other legal entities controlled by the same person as the Referrer.
  • Furthermore, reward cannot be granted for referred companies that are current customers of OnSinch or whose contractual relationship with OnSinch ended during the past 12 months prior to the referral submission.

6. Reward structure and receiving

  • The reward is based on the subscription plan selected by the Referred Company. The Referrer will receive 150 % of the Referred Company's monthly subscription payment excluding VAT, up to a maximum of €2,700 per successful referral.
  • The reward will be applied in the form of a discount to Referrer’s next OnSinch license payment after the Referred Company has signed the contract and made their first subscription payment. The reward may not be applied to invoices (subscription payments) issued to the Referrer before the conditions of right to a reward are met.
  • If the reward exceeds Referrer’s monthly subscription payment, the remaining amount will be applied to subsequent invoices. If there are no such subsequent invoices, the right of the Referrer to claim the reward or a part thereof ceases to exist.
  • The reward will be awarded to Referrer exclusively in the form of discount on OnSinch license payments. No provision of this Referral Program Terms constitutes a right of the Referrer or an obligation of OnSinch to payment of the reward or a part thereof in cash or via transfer of money. 
  • The Referrer is not entitled to unilaterally set off his claim to the reward against any monetary claims of OnSinch against the Referrer.

7. Referred Company referred by multiple Referrers

  • If multiple Referrers refer same Referred Company, the reward will be granted to the first OnSinch customer who submitted the referral, based on the timestamp of the referral submission.

8. Important disclaimers

  • OnSinch reserves the right to modify these Referral Program Terms at any time, at its sole discretion, and without any notice. OnSinch may also, in its sole discretion, change, cancel, suspend, or modify one or more aspects of the Referral Program without any notice. Continued participation in the Referral Program after any modification shall constitute consent to such modification. 
  • OnSinch also reserves the right to disqualify any Referrers at any time from participation in the Referral Program if OnSinch has a good faith belief that the Referrer has violated any of the Referral Program Terms.
